Xyience, the maker of Xenergy and the sponsor of the Ultimate Fighting Championship, got a reprieve when a judge OK’d a new loan that will allow the company to continue operating in bankruptcy while it seeks a suitor. Xyience, which makes and distributes the energy drink Xenergy, said it needed additional cash so it can keep the drink on the shelves of convenience and grocery stores. Lorenzo and Frank Fertitta own the UFC and also own Zyen, which earlier made a $1 million emergency loan to Xyience. Without the marketing agreement, Xyience would be forced to discard Xenergy drinks that show the UFC logo, said attorney Laurel Davis. Attorneys for three unsecured creditors and some Xyience stockholders objected to the financing and marketing agreements, but they offered no alternative to keeping the company in business. In a related development, Xyience reported that former co-CEO’s Frank Adams and Kirk Sanford resigned from the Xyience board, as did two outside directors, Jerry Kramer and Lanis O’Steen. read more
